5. What Data Do We Collect/Process?
5.1 Personal data we may collect on you will be:

5.2 We do not collect any special categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

6. Why Do We Collect/Process Your Data?
6.1 We only collect and process personal data in ways you, the candidate, would expect, in relation to our recruitment activities.
6.2 Where you, the candidate, appoint us to notify you of job opportunities and/or provide your details to potential future employers then our lawful basis for processing your personal data is contractual.
6.3 Where we process your personal data for speculative opportunities, then our lawful basis for processing your personal data is the legitimate interest of McCourt Newton as a professional Executive Search & Selection Recruitment consultancy.
6.4 Where we are acting on behalf of a Client, then our lawful basis for processing any personal data of data subjects employed by or working on behalf of that Client will be contractual.
6.5 We may wish to contact you to make suggestions and recommendations to you about positions or recruitment news that may be of interest to you.
6.6 We may wish to feature some candidates in our candidate brochure for marketing purposes, which we will only do with your consent.
6.7 We may monitor and record communications with you (such as telephone conversations and emails) for the purpose of quality assurance.
6.8 Where we need to collect personal data under the terms of a contract we have with you, such as to progress an application, and you fail to provide that data when requested, we may not be able to perform the services we are trying to offer you.

7. How Do We Collect Your Data?
7.1 We collect and process data given to us by you via our Site, or via direct telephone, email, face to face or other communication between yourself and McCourt Newton Ltd.
7.2 We may receive personal data about you from various third parties and public sources such as LinkedIn.

8. How Long Do We Keep Your Data?
8.1 Any data we collect will be processed and stored securely, for no longer than is necessary in light of the reason(s) for which it was first collected, e.g. for consideration against a particular role we are recruiting. 8.2 Any data we collect will be deleted no later than 12 months after the opportunity you contacted us about, or we contacted you about, has been completed, unless you agree to your details being retained on file as set out in section 8.3.
8.3 We will write to you to advise if we wish to retain your data to enable us to consider you for other career opportunities. You will be given the opportunity to opt out. If we do not hear from you, we will continue to hold and process your data.
8.4 We will contact you from time to time to check that the personal data we hold about you is accurate, complete and up to date. It is your right as a data subject to let McCourt Newton Ltd know of any changes to your details at any time in order for us to maintain the accuracy of information held on you.
8.5 If you do choose for your details to remain on file, we will either delete your personal data after two years, or, contact you again to ensure the details we hold for you are accurate, to advise that we continue to retain your details, and to give you the opportunity to opt out.
8.6 McCourt Newton Ltd will appropriately dispose of your personal data when it is no longer required, or if you ask to be removed from our systems to ensure it is protected from unauthorised use or disclosure.

9.1 If you apply to an advertisement via our website or a third party website, or we contact you directly to discuss a particular opportunity which you agree to be considered for, we will only discuss/share your personal data with the Client concerned.
9.2 We will only share your personal data with third parties, e.g. Clients we are recruiting on behalf of, with your explicit prior consent.
9.3 We will only share your personal data with Clients based outside of the European Economic Area with your explicit prior consent.
9.4 We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our Clients to use your personal data for their own purposes, and only permit them to process your personal data in accordance with our written instructions for recruitment purposes.

10. How and Where Do We Store Your Data?
10.1 We only keep your personal data for as long as we need to in order to use it as described in section 8.
10.2 Your data will only be stored by McCourt Newton in the UK.
10.3 Data security is very important to us, and to protect your data we have taken suitable measures to safeguard and secure any data we hold about you.
10.4 Steps we take to secure and protect your data include:
10.4.1 locks and security systems;
10.4.2 strong IT security systems with limited access to shared network drives to authorised personnel only, with firewalls and virus protection;
10.4.3 fully password protected and encrypted mobile devices;
10.4.4 the storage of any paper documentation in locked rooms/storage; and
10.4.5 training of all McCourt Newton employees on data protection, confidentiality and storage;

You have the right to ask for a copy of any of your personal data held by us (where such data is held) as specified by the GDPR, and we will provide any and all information in response to your request free of charge, unless there is a legal reason that prevents us from providing this information.
